DAVID V. SANDERSON is a Shareholder and has practiced in Phoenix for over 25 years.  He handles a broad range of real estate, finance, and business matters including: real estate development; hotel, resort, condominium, timeshare, and restaurant development,  operations and finance; real estate and commercial lending; real estate loan workouts and foreclosures; and zoning and land use approvals.  Mr. Sanderson primarily represents developers, lenders and other real estate entities.

Mr. Sanderson’s practice has included:

  • Developer representation in preparing the acquisition, project, and consumer sales and finance documents and regulatory registration for over 25 timeshare resorts developed by seven different developers in Arizona, California, Nevada, and Texas over the past 18 years.
  • Lender representation in documenting and closing over 50 real estate acquisition, development, construction, term, and permanent loans, timeshare acquisition, development, and receivables loans, commercial loan and timeshare receivables backed securitizations, and loan modifications and workouts for loans up to $100,000,000.
  • Developer representation in documenting and closing, and preparing opinion letters related to, over 100 real estate acquisition, development, construction, term, and permanent loans, timeshare acquisition, development, and receivables loans, commercial loan and timeshare receivables backed securitizations, and loan modifications and workouts for loans up to $200,000,000.
  • Lender and borrower representation in trustee sales and judicial foreclosures of residential and commercial loans and judicial foreclosure of owners association assessment liens.
  • Lender and borrower representation in residential, commercial, and timeshare loan workouts.
  • Developer representation in commercial and residential condominium development and conversion of over 15 projects in Arizona in the past two years.
  • Developer representation in preparing residential and commercial subdivision documentation, such as easements and covenants, conditions, and restrictions.
  • Formation and documentation of corporations, partnerships, limited liability companies, and owners associations, including formation of single asset special purpose entities.
  • Representation of landlords and tenants in residential and commercial lease negotiations and documentation.
  • Representation of hotel, timeshare, and restaurant operators in a variety of hospitality law matters.
  • Developer representation in over 100 zoning, subdivision, variance, site plan approval, and abandonment cases.

He received his B.A., with honors, from California State University Fullerton in 1973, and his J.D., cum laude, from Brigham Young University in 1976. He was an Associate Editor of the Brigham Young University Law Review and a State Farm Scholar.

Mr. Sanderson has taught continuing professional education seminars on real estate, real estate lending, foreclosure and development topics. He is a member of the American Bar Association, State Bar of Arizona and Maricopa County Bar Association, their Real Property and Business Law sections, and the American Resort Development Association. Mr. Sanderson is a former attorney of the month and attorney of the year of the Maricopa County Volunteer Lawyers Program.
